1. Prizing 1.1 Purchase prize   The agreed purchase price (net price) understands itself inclusive packing however without dispatch.   RTEC Sport Tuning reserves itself the right to change the prices at any time without notice in advance.   The prices published in the Internet at the date of the order are obligatory during 20 days starting from order for both parties. Reservations remain wrong prices and/or product specifications due to writing-, transmission- or other error. 1.2 VAT   If not inidicated differently all prices include Swiss value added tax (VAT). If the delivery address is outside Switzerland the VAT will be deducted. 2. Ordering   Each order with RTEC Sport Tuning and its on-line Shop order system is binding for both parties. RTEC Sport Tuning reserves itself the right to reject customers and orders at any time and without indication of reasons. 2.1 Offering   On request an offer with the goods which can be ordered is provided to the customer. The offer contains all costs and dates, as it at the time of the offers production admits is. The acceptance of the offer releases the order and billing procedure. 2.2 Online ordering   Each on-line order with acceptance of RTEC Sport Tuning represents a legal contract between the buyer and RTEC Sport Tuning.   Each on-line order is accomplished over a 128bit SSL coding. The customers data is protected by the Swiss data protection law and in no case it will given to others.   If a product is not on stock and must be ordered by our suppliers, the customer will be informed with one at this time admitted time for delivery. 2.3 Special orders   Products not available in our shoping system or that are out of stock, are offered to the customer as special order. If the value of the order amounts to more than CHF 900,00 and if the customer accepts the offer, then 20% of the value are charged in advance (see terms of payment). 2.4 Cancellations   The cancellation of an order is only possible for products on stock and up to the time of the distribution from stock Nuerensdorf. Basically, the cancellation of a special order is not possible. However if special circumstances lead to a cancellation of the order and this is accepted by RTEC Sport Tuning, the customer must pay a fee of 20% of the purchase value. 3. Terms of payment 3.1 Payment   RTEC Sport Tuning offers different ways of payment, which are agreed with the purchase for the goods online. A subsequent change of the manner of payment is possible in special exceptional cases after arrangement. 3.2 Credit Card payments   We accept payments with the VISA and Eurocard credit card.   All cerdit card payments are done in Swiss Francs (CHF).   All credit card transactions are coded with 128 bit SSL and are not observable by any other party. Credit card information is stored coded by us only. The deduction of the purchase price takes place only with distribution of the goods ordered.   In case of special orders in the value of more than CHF 900,00 the customers credit card is charged in advance with 20% of the purchase value when the order was accepted. With the delivery of the goods the remainder will be charged from the customers credit card. 3.3 Cash sales   At collection of the ordered goods the trade can be closed by cash payment.   In case of special orders in the value of more than CHF 900,00 the customer must pay 20% of the purchase value in advance when the order was accepted. With the delivery of the goods the remainder is due. 3.4 Advance payment   To receipt your order we send you a confirmation by email with all our payment instructions or by letter with paying-in slip. As soon as the amount was received with us, we deliver the purchased goods. 3.5 COD   Purchases in the value of up to CHF 900,00 can be dispatched by COD. The buyer bears the additional cost. With non-acceptance of the buyer, all arising costs including the renewed dispatch are beared by the customer. Only a further setting attempt is undertaken. Afterwards the regulation applies over the cancellation of an order and the buyer will be billed with the upcounted fees. COD is possible only in Switzerland. 3.6 Paying-in slip   Supply on paying in slip basis is possible only in Switzerland and on companies registered in the trade register. The payment of the goods is possible within one period of 10 days.   In case of special orders in the value of more than CHF 900,00 the customer must pay 20% of the purchase value in advance when the order was accepted. With the dispatch of the goods the remainder becomes due within 10 days. 4. Delivery of goods 4.1 Delivery   The ordered goods are sent out from our stock in Nuerensdorf/Schweiz. In special cases, direct supply from the manufacturer can be agreed with RTEC Sport Tuning. In the case of supply the effective transportation/postage costs are charged to the place of delivery, which are to be paid in advance to the purchase price. Upon request from the buyer shipping can be insured (COD or delivery receipt) on his own cost. Shipping Local tax (VAT) or handling costs are carried out by the buyer.   The goods are only delivered when the payment has arrived, or a valid credit card was given for payment.   The date of delivery is communicated to the customer either by email or phone. 4.2 Dates of delivery   For the confirmation of the order a date of delivery which is based on our current status of information is indicated to the customer. Depending upon the order and supplying situation the delivery dates can be change at short notice. In case of a change, the customer will be informed immediately by email or phone. Possible exceeding of the delivery date entitle neither to the cancellation of the order nor to the asserting of claims. 4.3 Wrong delivery   If the goods delivered by RTEC Sport Tuning have not been ordered, RTEC Sport Tuning commits itself to take these back without costs for the customer. The customer must communicate the incorrect supply within two to working days after reception.   The delivery of the correct goods takes place directly after receipt of the wrong products. Goods are excluded, which are not on stock or still on delivery of our supplier. These are continued to dispatch immediately after receipt with RTEC Sport Tuning to the customer at no costs. No additional costs arise for the customer. 4.4 Incomplete delivery   If the goods delivered by RTEC Sport Tuning are not complete, RTEC Sport Tuning commits itself to supply these without costs for the customer. The customer must communicate the incomplete supply within two to working days after reception.   The delivery of the missing goods takes place directly after receipt of the wrong products. Goods are excluded, which are not on stock or still on delivery of our supplier. These are continued to dispatch immediately after receipt with RTEC Sport Tuning to the customer at no costs. No additional costs arise for the customer. 4.5 No reception of delivery   Goods with a total weight below 2kg (incl. package) are shipped without insurance by Swiss Post. Optional the buyer can request for insurance of the goods. The buyer will be charged for the additional costs of COD or receipt on delivery. RTEC Sport Tuning is not responsible for the loss of the package if RTEC Sport Tuning handed the package over at the post office, paid for shipping and the buyer did not request for insurance.   If the goods have been insured, RTEC Sport Tuning will initiate a search for the package at the Swiss Post. If the ordered goods are on stock, RTEC Sport Tuning will send them immediately out to the buyer again. If the goods are not on stock the buyer can chose to cancel the order by receiving the money back, to let RTEC Sport Tuning to order the parts at its supplier or a change in goods on the order. In this case the buyer will not have to pay additional costs. 5. Notices of defect   Notices of defect of the delivered goods must be brought to attention to RTEC Sport Tuning by writing within 5 working days after receipt. If RTEC Sport Tuning recognizes the defects, the customer has requirement on removal of the lack, or if this is not possible, on supply of perfect substitute. The criticized article must be sent back to RTEC Sport Tuning within 8 working days.   Exceptions are parts delivered directly from the manufacturer, which were not on stock at RTEC Sport Tuning and therefore could not be checked. RTEC Sport Tuning will inform the supplier about a return. The costs of the dispatch after instruction of RTEC sport Tuning are refunded to the customer in full. 6. Returning goods   Returns of goods are only accepted after arrangement with RTEC Sport Tuning within 8 days starting from date of delivery. The supplied goods must be returned intact and functionally in unopened, perfect original packaging with the original delivery note.   The cost of insurance and dispatch must be paid by the buyer.   The regulations apply over remote sales contracts in the Swiss Law. 7. Warranty   The warranty consists in the obligation to replace the parts which exhibit a factory defect free of charge. With repairs the warranty extends only to the repaired parts.   The guarantee of RTEC Sport Tuning is determined according to the terms of the warranty of the respective manufacturer/supplier. The customer waives any further warranty claims to RTEC Sport Tuning and the manufacturer/supplier. The only obligation of RTEC sport Tuning consists of surrendering possible own warranty claims against the manufacturer/supplier to the customer. The warranty works are furnished by the supplier within the normal work time. The warranty works are made compellingly by the channels designated by the manufacturer/supplier and not via RTEC Sport Tuning. Possible additional costs are charged separately.   The customer is not entitled to request further claims because of any announced warranty claims. 8. Liability 8.1 Non-liability   RTEC Sport Tuning is not liable for any damage caused directly or indirectly by the operation, use, possible disturbances or operational failure of the products delivered by RTEC Sport Tuning.All warranties of defects and consequential damage are excluded that may occur due to the installation and use of the products supplied by RTEC Sport Tuning. Also all escaped profit or requirements by any other party are excluded by the liability of RTEC Sport Tuning. 8.2 Regulation determinations of goods   RTEC Sport Tuning is not liable for the legality of the goods sold. They underlie the regulation determination of the respective law of the country/region of the buyer. The customer accepts that many products offered with RTEC Sport Tuning are only intended for off road racing purposes and not for the use on official road.   The customer is obligated to inform himself about the necessary legal guidelines and occurences in his country and is even responsible for possible consequences of the illegal use of the goods before the order. A later cancellation of an order due to the existing laws is not possible.   RTEC Sport Tuning is not liable for any claims due to warranty loss, which can result from use and installation of the products sold by RTEC Sport Tuning. 9. Miscellaneous   Verbal agreements are obligatory only if they are confirmed in writing by RTEC Sport Tuning   In all other respects the regulations of the Swiss law apply. 10. Court of jurisdiction   For all disputes the parties agree for Nuerensdorf (district court Buelach) as court of jurisdiction.
